1) Warranties
Goods all have different warranties and these are explained at time of sale.
Goods that are deemed seconds or floor models have only 3 months warranty unless specified on the invoice.
2) The warranty shall be void if
i) TJ’s determines that abuse or misuse has been the cause of the damage or defect. (e.g., customers swinging on the backs of lounge suites, sitting on arms etc).
ii) The goods have been altered, customized, reupholstered or damaged by the customer.
iii) The goods have been damaged when being moved by the customer (e.g., where the address is different from the invoice).
iv) The damage is from fading caused by direct or indirect sunlight from windows etc.
v) Where the damage has been caused by animals.
vi) The items have been used in commercial or general non-domestic use.
vii) The damage is normal wear and tear.
viii) The customer has failed to follow the correct care programme.
ix) All warranties are a return to base (RTB) warranty it is the customer’s responsibility to cover the cost of transport back to TJ’s irrespective of whether the damage is subsequently covered by this warranty or otherwise.
3) LAY-BY POLICY
1) Lay-by purchases are accepted on the following bases:

There is a requirement of 30% deposit of purchase price at the start of the lay-by (purchase date).

ii)
|
Goods on lay-by must be paid for in FULL within 8 weeks of the purchase date.
|
|
iii)
|
If the customer exceeds this period of 2 months, a storage charge of $25.00 + GST per week shall apply effective immediately.
|
|
iv)
|
If the customer cancels the transaction, an administration fee of $60.00 + GST will apply. A cancellation fee of 25% of the total sale may also apply.
|
|
v)
|
All storage and administration fees will be deducted from payments made when making the customer’s refund.
|
|
vi)
|
TJ’s reserves the right to cancel the sale at any time as it sees fit if the buyer does not meet the payment schedule and/or minimum payment as agreed above.
|
|
vii)
|
TJ’s reserves the right to hold the goods until the buyer makes full and complete payment.
|
|
viii)
|
Goods may not be available until the agreed full payment date stated on the lay-by agreement is made.
|
4) DELIVERY POLICY
1) Every effort will be made to ensure that goods arrive on time, undamaged and without defects.
2) Please make sure to measure all doorways, hallways, stairways, and elevators if necessary and make sure that the goods can fit in your home.
3) TJ’s will contact the customer with a delivery time prior to delivery. This time is only an estimated time and may vary.
4) All goods must be paid in full prior to actual delivery.
5) TJ’s shall not be liable for delays beyond its control whether caused by weather, unexpected traffic conditions, and other complications beyond its control.
6) Delivery charges are based on a simple delivery. Where access is deemed difficult by the delivery staff (e.g. balconies or narrow stairways), the delivery staff are not obliged to deliver the goods into your home. Under such circumstances, staff reserve the right to leave the goods in a more accessible place (e.g. garage or shelter) or if necessary outside your front door that gives access to your home. Thereafter it is the buyer’s responsibility to move the goods into the home.
7) TJ’s shall not be liable for any damage to the goods or property of the customer howsoever caused by delivery staff during delivery. (e.g. Items purchased or windows)
8) If delivery takes up more than a reasonable amount of time due to circumstances outside of TJ’s control and where TJ’s delivery staff have other commitments, delivery staff reserve the right to leave the goods wherever necessary close to customer’s house.
9) When goods to be delivered by us cannot be delivered on an agreed delivery date, which is due to the customer's own unavailability, an extra delivery charge will apply for any redeliveries.
10) Any goods deemed by both the customer and TJ’s delivery staff to be damaged or incorrect upon delivery will not incur an extra delivery charge for subsequent redeliveries.
11) In the event that you need to cancel or reschedule your delivery, we must be informed by midday on the delivery day otherwise extra delivery charges will apply.
12) A third party delivery company may be used at TJ’s discretion and the above terms & conditions will still be adhered to.
5) CANCELLATION AND REFUNDS
Any goods purchased from TJ’s that are faulty will be repaired or exchanged as per our obligations under the Consumer Guarantees Act 1993.
1) There are strictly no refunds on items where a customer has simply changed there minds or chosen the wrong color/fabric or item.
2) TJ’s reserves the right not to accept any cancellation of a purchase, If goods are custom made for a customer then no cancellation or amendment will be accepted.
3) Where delivery is delayed through circumstances outside the control of TJ’s (as outlined in s 3(2)) or (delay of imports due to overseas conditions) the customer may NOT cancel their order.
4) Total amount refundable is limited to the amount received by TJ’s from the customer.
6) LIMITATION OF LIABILITY
1) TJ’s shall not be liable for any damage or injury on or by the goods purchased. The customer waives all claims existing now or at any time thereafter against TJ’s
2) Nothing said by any salesperson or representative on TJ’s behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by TJ’s, unless agreed in writing by TJ’s management only.
3) Except for fraud or fraudulent misrepresentation, TJ’s shall not be liable for such representations being untrue or misleading.
7) GENERAL
1) For any customer requests, customers must provide the original invoice.
2) Goods are sold for domestic / household use only. All statutory warranties and remedies are excluded to the maximum extent permitted where goods are purchased for commercial or business purposes.
3) Prices advertised or quoted are subject to change without prior notice.
4) Goods advertised or quoted are subject to availability.
5) TJ’s reserves the right not to accept any purchase request if:

We have insufficient stock;

b.

We do not deliver to your area;
|
|
c.
|
Payment transaction was not authorized
|
|
d.
|
One or more of the goods was incorrectly advertised, quoted, or priced.
